Potential Cause of Action

Aggravating Circumstance: The manufacturer may have facilitated and encouraged the off-label use of Avastin® for approximately 9,500 breast patients prior to receiving FDA approval for breast cancer use.

In that Avastin® is intended to treat cancer, a potentially fatal disease, the prescribing of Avastin® may have delayed other treatments that although more radical, may have proven to be effective.

Studies have shown Avastin® can cause death and serious injury, including gastrointestinal perforations, surgery and wound healing complications, hemorrhage, congestive heart failure, blood clots, neutropenic infection, and kidney disorders.

2004—FDA approves Avastin® for colorectal cancer.

2007—Panel of outside FDA advisers votes 5 to 4 against approval for breast cancer treatment, indicating the drug’s benefits did not outweigh toxic side effects.

“Nevertheless, U.S. doctors continued prescribing it ‘off-label,’ or without a federal endorsement.” Huffingtonpost.com

2008—FDA grants drug “accelerated approval” for breast cancer.

2010—FDA Advisory Committee votes 13 to 0 that the new studies failed to confirm the original findings and 12 to 1 that the agency should rescind marketing approval for breast cancer.
